Stanley Liang filed a petition for certiorari in the U.S. Supreme Court in August 2018. The petition, ultimately not granted, relates to the scope of patentable subject matter under 35 U.S.C. s. 101. The petition highlights the tension between two Supreme Court decisions: Funk Bros., which articulates a more restrictive standard, and Myriad, which articulates a less restrictive standard. The petition also points out the need for a court to provide truly meaningful review when it reviews a PTAB decision.
